General terms and conditions for driving schools, based on the paper version supplied by the operator. This English translation is provided for information and remains a draft for review.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

1. Training and contract<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Scope of training. Driving instruction includes theoretical and practical lessons. Written training contract. Training is provided under a written training contract. Legal basis. Lessons are provided in accordance with the applicable legislation and regulations issued under it, in particular the German Learner Driver Training Regulations (Fahrsch\u00fcler-Ausbildungsordnung). The following terms also apply and form part of the training contract. End of training. Training ends when the driving test is passed and, in any event, six months after the training contract is concluded. If the training relationship continues after it has ended, the driving school's fees shown in the price list specified under section 32 FahrlG at the time of continuation apply to the services offered. The driving school must draw attention to this when training continues. Lack of fitness to drive. If, after the contract is concluded, it becomes apparent that the learner does not meet the physical or mental requirements for obtaining a driving licence, section 6 applies to the driving school's services.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

2. Fees and displayed price list<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Fees and displayed prices. The fees agreed in the training contract must correspond to those displayed at the driving school.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

3. Basic fee, driving lessons and tests<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Basic fee and services. a) The basic fee covers the driving school's general expenses, theory lessons and required preliminary tests up to the first theory test. Partial basic fees following a failed theory or practical test. For further training following a failed theory test, the driving school may charge the partial basic fee agreed in the training contract, up to half the basic fee for the relevant licence category. A partial basic fee may not be charged following a failed practical test. Driving lesson fees and services. b) The fee for a 45-minute driving lesson covers the training vehicle, including vehicle insurance, and practical instruction. Cancellation and notice. A learner who cannot attend an agreed lesson must notify the driving school without delay. If a lesson is not cancelled at least two working days before the agreed time, the driving school may charge compensation equal to three quarters of the lesson fee. The learner remains entitled to demonstrate that no loss occurred or that the loss was substantially lower. Test presentation fees and services. c) The fee for presentation for a test covers presentation for the theory and practical tests, including the test drive. For repeat tests, the fee agreed in the training contract applies.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

4. Payment terms<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Payment terms. Unless otherwise agreed, the basic fee is due when the training contract is concluded, lesson fees before the lesson starts, and the test presentation fee together with any administrative and test fees paid in advance no later than three working days before the test. Withholding services for unpaid fees. If payment is not made when due, the driving school may withhold further training and test registration until the outstanding amount is paid. Fees when training continues. Any fee for additional theory training required under section 3a, paragraph 2 must be paid before that training starts.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

5. Termination of the contract<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Termination. The learner may terminate the training contract at any time; the driving school may do so only for good cause. Good cause exists in particular if the learner a) despite a request and without valid reason fails to begin training within four weeks of concluding the contract or interrupts training for more than three months without valid reason, b) fails the theory or practical driving test after two repeat attempts in each case, or c) repeatedly or seriously disregards the instructor's directions or instructions. Text form. Termination of the training contract is effective only if made in text form.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

6. Fees following termination<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Fees following termination. If the training contract is terminated, the driving school is entitled to payment for lessons provided and any test presentation already carried out. If the driving school terminates for good cause, or the learner terminates without being prompted by a breach of contract by the school (see section 5), the school is entitled to a) one third of the basic fee if termination occurs before theory training starts; b) two thirds if termination occurs within six weeks after training starts; c) the full basic fee if termination occurs more than six weeks after training starts. The learner may demonstrate that no fee or loss of the stated amount arose, or that a lower amount arose. If the driving school terminates without good cause, or the learner terminates because of a breach of contract by the school, the school is not entitled to the basic fee. Any advance payment must be refunded.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t

7. Keeping agreed appointments<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Agreed appointments. The school, instructor and learner must ensure that agreed lessons start on time. Lessons generally start and end at the driving school. If this is changed at the learner's request, the travel time used is charged at the lesson rate. If the instructor is responsible for a late start or interrupts practical instruction, the lost training time must be made up or credited. Waiting time. If the instructor is more than 15 minutes late, the learner need not wait longer. If the learner is responsible for a late start, the lost training time is at the learner's expense. If the learner is more than 15 minutes late, the instructor need not wait longer. The agreed training time is then treated as missed (section 3b, paragraph 3). Compensation. Compensation for missed training time is also three quarters of the lesson fee. The learner may demonstrate that no loss occurred or that the loss was substantially lower.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

8. Exclusion from lessons<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Exclusion from lessons. The learner must be excluded a) when under the influence of alcohol or other intoxicating substances, or b) when there are otherwise reasonable doubts about their fitness to drive. Compensation. In this case, the learner must also pay compensation equal to three quarters of the lesson fee. The learner may demonstrate that no loss occurred or that the loss was substantially lower.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

9. Care of training equipment and vehicles<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Care of equipment and vehicles. The learner must take proper care of training vehicles, teaching models and other teaching materials.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

10. Operating training vehicles and motorcycle training<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Operating training vehicles. Training vehicles may only be operated or started under the instructor's supervision. Breaches may result in prosecution and liability for damages. Special duties in motorcycle training. If communication between learner and instructor is lost during motorcycle training or a test, the learner must stop promptly at a suitable place, switch off the engine and wait for the instructor. The driving school must be notified if necessary. When leaving the vehicle, the learner must park it properly and secure it against unauthorised use.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

11. Completion of training and test registration<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Completion of training. The driving school may only complete training when it is satisfied that the learner has the knowledge and skills needed to drive a motor vehicle (section 29 FahrlG). The instructor therefore decides, exercising proper professional judgement, when training is complete (section 6 FahrschAusbO). Test registration. Registration for the driving test requires the learner's agreement and is binding on both parties. If the learner does not attend the test, they must pay the test presentation fee and any fees incurred or paid in advance.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

12. Place of jurisdiction<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Jurisdiction. If the learner has no general place of jurisdiction in Germany, moves their domicile or habitual residence abroad after the contract is concluded, or their habitual residence is unknown when proceedings begin, the driving school's registered location is the place of jurisdiction.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

13. Data sharing in connection with the training contract<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

DATAPART Factoring GmbH may share personal data with companies providing contractually agreed services in connection with the training contract.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t

14. Billing through DATAPART<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Amounts due under the training contract are billed exclusively by DATAPART Factoring GmbH, to which the driving school has assigned these claims. To discharge their payment obligation, the learner must pay these invoices exclusively to DATAPART Factoring GmbH, 71636 Ludwigsburg. DATAPART may make electronic statements of services available in an online portal or send them by email.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
